Terms of Service
Last updated: September 2026
These Terms of Service ("Terms") govern access to and use of Extinguo (the "Service"), provided by [operator legal name] ("we", "us"). By creating an account or using the Service, the servicing company you represent ("Customer", "you") agrees to these Terms. The Service is offered to fire-safety servicing companies in multiple countries; these Terms are written to apply regardless of where a Customer is based.
1. What the Service is
Extinguo is a software tool that helps fire-safety servicing companies organize their own operations: keeping track of client sites and equipment, scheduling and recording service visits, generating documentation, and communicating with their own clients. It is an organizational and record-keeping tool for the Customer's business.
2. Not a compliance or inspection authority
The Service does not perform, certify, verify, guarantee, or take any responsibility for the physical inspection, maintenance, recharge, or repair of any fire-safety equipment. All servicing work, its quality, and compliance with applicable fire-safety laws, regulations, and standards are the sole responsibility of the Customer and its technicians. Any date, reminder, certificate, or report shown in the Service reflects information the Customer (or its staff) entered, and is not independently verified by us. We help a Customer organize and document its own compliance process โ we are not a party to it, and we make no representation that using the Service satisfies any Customer's legal or regulatory obligations in its own jurisdiction.
3. Accounts, access, and your own users
The Service is invite-only. A Customer's designated administrator manages who on their team has access, and is responsible for keeping login credentials confidential and for all activity that occurs under their firm's account, including actions taken by employees they've invited. Each person using the Service must do so under their own individual account โ sharing one login across multiple real people is not permitted, both because it breaks the audit trail the Service relies on to attribute work, and because it may violate the terms of the Customer's own subscription plan. A Customer is responsible for promptly removing access for anyone who leaves their organization.
4. Your data
The Customer owns the data it enters into the Service โ client lists, equipment records, service history, and related information. The Customer is responsible for the accuracy of that data โ including that any service, inspection, or visit recorded in the Service actually took place as described โ and for having any rights or consents necessary to store its own clients' contact information within the Service. See our Privacy Policy for how we handle that data.
5. Acceptable use
You agree not to: use the Service for any unlawful purpose; enter false, misleading, or fabricated service records; attempt to access another firm's data or account; attempt to reverse engineer, scrape, or disrupt the Service; circumvent any usage or seat limit of your plan; or share invite links or credentials with anyone outside your organization.
6. Availability
We make reasonable efforts to keep the Service available and to give notice of planned maintenance, but we do not guarantee uninterrupted or error-free access. The Service is provided "as is" and "as available," without warranties of any kind, express or implied, except as expressly stated in these Terms.
7. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages, or for any loss or claim arising from a Customer's own fire-safety compliance failures, missed or inadequate servicing, equipment failure, false or inaccurate data entered by the Customer or its staff, or reliance on data the Customer itself entered into the Service. Our total liability for any claim relating to the Service โ however arising โ is limited to the fees paid by the Customer in the 12 months preceding the claim.
8. Indemnification
The Customer agrees to indemnify and hold us harmless from any claim, loss, or liability (including reasonable legal fees) arising from: the Customer's use of the Service in violation of these Terms; data the Customer entered, including its clients' personal information entered without proper consent; the Customer's own fire-safety servicing work or its failure; or misuse of the Service by anyone the Customer granted access to.
9. Termination and your data on exit
Either party may terminate access to the Service. We may suspend or terminate an account for breach of these Terms, non-payment, or suspected fraudulent or abusive use, with notice where reasonably possible. On request, a Customer can export the entirety of its own data (clients, units, service history, employees) at any time while its account is active, and for a reasonable period after termination.
10. Force majeure
Neither party is liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to natural disasters, internet or infrastructure outages, war, or government action.
11. Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms. Material changes will be communicated to account administrators.
12. Governing law and disputes
These Terms are governed by the laws of [jurisdiction of incorporation โ to confirm once the operating entity is set up], without regard to its conflict-of-law principles, except where a Customer's local law mandatorily grants different protections that cannot be waived by agreement. Before pursuing formal proceedings, both parties agree to first attempt to resolve any dispute in good faith directly.
